Terms of Service

1. Agreement

By creating an Estatly account or using the Service, you agree to these Terms. If you are using Estatly on behalf of a brokerage or team, you represent that you have authority to bind that organization.

2. Eligibility

You must be a licensed real estate professional, broker, or affiliated team member, at least 18 years of age, and able to form a binding contract under applicable law.

3. Subscription & Billing

Plans are billed monthly in advance via Stripe. A 7-day free trial is offered on every plan. You may cancel at any time from your billing portal; cancellation takes effect at the end of the current billing period. Refunds are issued only where required by law.

4. Acceptable Use & Compliance

You will use Estatly in compliance with the federal Fair Housing Act, TCPA, CAN-SPAM, all state real estate licensing rules, and MLS rules of participation. You will not use Estatly to send unsolicited marketing to consumers without proper consent, or to discriminate against any protected class.

5. AI-Generated Content

Estatly produces AI-generated marketing copy, lead replies, and CMAs. You are solely responsible for reviewing AI output before sending it to consumers or using it in advertising. Estatly does not guarantee accuracy of comparable sales, market estimates, or other AI-generated valuations.

6. MLS & Third-Party Data

You are responsible for maintaining valid MLS credentials and complying with each MLS's IDX, VOW, and data redistribution rules. Estatly is not a party to your MLS agreement.

7. Your Data

You retain all rights to data you upload (leads, contacts, listings). Estatly processes it solely to provide the Service, per our Privacy Policy and Data Processing Agreement.

8. Termination

We may suspend or terminate accounts that violate these Terms, Fair Housing rules, TCPA, or MLS rules. On termination, you may export your data within 30 days.

9. Disclaimers & Limitation of Liability

The Service is provided "as is." Estatly disclaims all implied warranties to the maximum extent permitted by law. Our aggregate liability is limited to the amounts you paid in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Disputes will be resolved by binding arbitration in Wilmington, DE, except either party may seek injunctive relief in court.
